Terms of use
Version: As of 14 Oct 2026 · Scope: Referral platform Pflege Patienten (new version)
Section 1 Provider and scope
These terms apply to the use of the referral platform Pflege Patienten of PHP Schmiede KG, Hagenstr. 18, 48429 Rheine, Germany (hereinafter ‘Provider’). They apply to referrers who post a care need and to care providers that accept care.
Section 2 Services of the platform
(1) Referrers can post a care need. The platform informs all registered care providers that are eligible under the participation rules, whose service area covers the place of the care need and that offer the type of care required (care request). Neither the Provider nor the referrer selects the care providers that are notified.
(2) Care providers can express interest in the entire care or in individual services. An acceptance only comes about once the referrer and the care provider have confirmed it. The contract for the care service is concluded exclusively between the care provider and the person receiving care.
(3) The Provider does not owe a successful referral or a particular number of requests or responses.
Section 3 Registration and access
Use requires registration. Sign-in details must be kept secret. A location can post care needs and – with a location subscription – accept care. If an organisation belongs to an umbrella organisation, the umbrella organisation can read with the organisation’s separate consent, which can be withdrawn – separately for key figures and for case contents; it never makes changes.
Section 4 Obligations of referrers
(1) Referrers only post details that are necessary for the referral and use the fields provided for this purpose.
(2) Before posting, organisations obtain the consent of the person concerned to the referral and confirm this in the portal. For the case data they conclude a data processing agreement (Auftragsverarbeitungsvertrag, AVV) with the Provider.
Section 5 Obligations of care providers
(1) Care providers only express interest in services that they can actually provide and use case data exclusively to review and agree the care.
(2) Care providers agree that, for its documentation – for example of discharge management (Section 39(1a) SGB V) or of the requirements for transitional care in hospital (Section 39e SGB V) – the referring organisation sees which care providers were notified about a case – with the name of the care provider, the date and the result of the response. This is not shown to other care providers.
(3) There is no preferential notification or position in return for payment.
Section 6 Fees
(1) Posting care needs is free of charge.
(2) A location subscription is required to accept care. It costs €99.00 plus VAT per location per month per contract month; the first contract month starts with the subscription. It has no minimum term and can be cancelled at the end of the current contract month. The Provider issues the invoices through the portal. The location subscription starts with the first expression of interest of the location concerned, which can only be made after the price and the contract terms have been expressly confirmed; registration and approval are free of charge. Other locations of the same organisation are not affected.
(3) Without this confirmation, no interest is expressed and no subscription is taken out. After a subscription ends, ongoing agreements can still be worked on; new expressions of interest require a new subscription.
(4) A change to the price of an existing contract requires an express agreement. We send you a corresponding offer to change the price at least six weeks before it is intended to take effect. Silence does not constitute consent. Without your consent, the previously agreed price continues to apply until the contract is effectively terminated. Both parties can terminate the contract in accordance with the agreed ordinary termination rules; statutory rights remain unaffected. Statutory changes to the VAT rate are taken into account accordingly.
Section 7 Liability
We are liable without limitation for intent and gross negligence, for injury to life, body and health and under the German Product Liability Act (Produkthaftungsgesetz). In the event of a slightly negligent breach of material contractual obligations, our liability is limited to the foreseeable damage typical for the contract; otherwise liability is excluded. The decision on admission and care lies solely with the care provider.
Section 8 Final provisions
The law of the Federal Republic of Germany applies. The place of jurisdiction for merchants and legal entities is Rheine. If individual provisions are invalid, the remainder remains valid.
